The FX got owned by my APT gate...grr

So anyways in the 3 months that I've owned the FX, I have had some seriously rotten luck (see my post about the 6th day of ownership, getting broken into ~$12K damages).

When I was gearing up to go to the Dallas mini meet (just washed her...) to meet up with Stu (Stulax18) and Kim (KNFX), I was leaving my apartment complex one of the gate doors closed on the FX!!!

Damages to the rear passenger door, rear quarter panel, tire, rim, fender, and bumper.

This especially sucks because I'm an under 25 male, and Insurance is hella expensive. This will be the 2nd time in 3 months that I have paid my $1,000 deductible. The $2,000 in deductible I've paid in the past 3 months sure is putting a damper on any modding... grr. :mad:

And no, I can't go against the apt complex to recover any $, because there is a hold harmless in the lease agreement, sigh*.

Just got the car back from the shop, $2,300 is the total bill. Only positives to come out of this thing are that I got an alignment out of the deal, and had a G37 rental.

ouch....

apt is not at fault? what if it was a kid there that got hit or crushed by the gate? you would think they have sensors on the ground to keep the gate open. sounds like a liability issue to the apt complex
 
Gates can be stupid sometimes though, I told him a story about my friend who had this happen also, after I saw the damage.
 
Wow, glad you got it fixed. But there has to exceptions to that hold harmless clause.

A couple of issues though. 1.) No witnesses. <-- this is big.

In the event if it was a child or something that got caught in it, odds are the damages would be much worse ($10K++) and may be worth pursuing.

However I'm really only out my $1K deductible. If I wanted to go after the apartment for this cost, the attorney fees would cost more than the deductible. Also, I would have to prove beyond a reasonable doubt that it malfunctioned... without witnesses that would be quite difficult.

So I basically just have to suck it up and eat another $1K.

To put it in perspective (this is hella depressing), the total I will have spent on car insurance this year:

$1,000 - deductible
$1,000 - deductible
$200 - extra rental fees and other crap
$900 - 6 months insurance premium
$900 - 6 months insurance premium

$4,000 of my after-tax dollars. When I look at this number as a function % of my overall salary, it is quite depressing :mad:.

Imagine the fun mods I could have done!
 
If you are going to count insurance coverage, then you gotta count gas too. There's no choice for either of them.

Deductible is different - you don't HAVE to get it fixed. But I'm not hatin - I would have done exactly what you did. Just sucks that you have to deal with it at all.
 
If you really wanted to get it back, represent yourself, and film the gate malfunctioning. If it is a problem, it should happen again. Or ask other tenants if they've seen it happen also, but maybe they got through.
 
Yeah, good point. We don't have a gate at our new house since there's really no driveway. We had a gate at our last house you had to get out to open. Sometimes I would just ram it open if it wasn't latched. This wasn't in the FX though. :laugh:
 
HAHA I know that I would easily get to that point when I would get supper pissed off and just ram the crap out of it! Especially if it hit my FX!
