Rear Hatch Lock Issues

Having problems with the rear hatch locking mechanism. I am getting a message saying that it is not closed on the dash. Also, when using the Ikey button, or try using the fob, the car will only beep at you saying the door is open and will not lock. THE DARN THING IS LOCKED AND CLOSED! It locks and pulls the door closed everytime. The alarm keeps going off at my wife's work as well, and she's received a warning. Now she just keeps the car unlocked at work so it will not go off anymore.

With the car on or ACC, if the message is on, I can press down lightly on the hatch and the door open warning goes away. I have tried adjusting the stoppers for really long and really short... hasn't helped. Is there some sensor in the locking mech that telling the car it's open? Or has the lock finally just wore out and needs replacement? It is 12 years old, and I know all the locks on the FX are horrible.
 
Wifey actually got called into the office this week due to the alarm continuously going off.

Bought a new rear hatch lock actuator off of Infinitipartsonline.com for $351. Installed and? Nothing.. Absolutely nothing! The lock wasn't pulling the hatch closed at all. I went through all of the fuses and everything seemed fine.

Just for the heck of it, I took out and put back in the rear hatch fuse. Damn thing started working! Closes perfectly and there is NO warning lights on the dash...

Nice that works out. But funny how you have to pull the fuse to get it going. With my old FX35, I bought a used hatch lock for a G35 and swap in the G35 actuator into the FX35 hatch lock assembly without messing with the fuse.
 
No idea, it had me stumped and looking for a blown fuse. When I pulled out the non working latch, I heard a click from the little black box next to the latch. I installed the new one, no power at all to the motor. The old one still tried to pull the hatch down but had some movement when closed. The new one has 0 movement when closed. Just literally pulled out the old fuse and put it back in.. Wala working... Strange.
