FX50 low RPM drone, exhaust? Trans? normal?

Hey guys, only about 6 weeks into FX50 ownership, really enjoying it (do miss my 45 though). I hear a drone at around 1700 RMP when accelerating slowly, then its gone. I can't tell if it's a normal exhaust note or maybe a leak or perhaps even the transmission. Can any FX50 owners shed some light on this? Mine is a 2010
 
It's the transmission. The way the transmission is programmed is to stay in a high gear at lower rpm's. This causes the car bog down at low rpm's makes the exhaust drone as the engine bogs. Normal at least for these cars

I tried arguing with Infiniti about this issue, there is even a youtube video that illustrates the problem, just search for: “2009 Infiniti FX35 Transmission is Strange”, but according to Infiniti, this is as per design.
I looked for a solution since getting the car in 2011, but never found it, so I've decided to return the car at lease end over this issue ONLY.
Infiniti claims that it's because of a new 7 speed transmission, but BMW has 8 speed and no such issue.
This is just my story.
 
did you guys get the reflash? I barely drive my fx50 in D mode let alone DS. Usually shift myself around town because I hate how the 7 speed is always looking for a gear. On the highway it's fine.
 
I had the reflash. Also, there was a software upgrade in regards to this issue which I got, but none of those fixed my issue.
