Engine is dead at 114000km (70,000 miles) 2009 fx50

Honestly, I can see his point. He bought a CPO vehicle and 4k km's out of warranty the engine goes. That's only 2400 miles. In the US, that engine would have likely been replaced under goodwill. It happens all the time for all the car makers. Not sure why, but in Canada, the rules seem more strict.

I am not exactly sure why you think Infiniti needs to cover this but I hope it ends up working out for you regardless. I think you need to find out what happened to the engine itself. The mechanic probably found a lot of metal in the oil when they drained it, that is usually due to spun/destroyed rod bearings which is usually detonation related. Were you running premium fuel? Has your car been modified, specifically your ECU? Just saying the engine is 'dead' is a vague term and can be related to lots of issues, bent rods, broken pistons, broken crank, etc.. The amount Infiniti will fight you will depend on the cause of the failure. To help keep you happy they may offer to help you out but are under no obligation to cover this as disappointing as this is.

Again, hope it works out for you but find out what the failure is for sure.
 
As shadow mentioned, I've had many parts replaced outside of the warranty period on previous rides. I've been told they are allowed to pass a certain mileage and days past warranty...usually by quite a bit, but with the discretion of the dealership. Canada, I don't know.

My experience was with ford and even the FX. The a/c hose the dealer said they would do goodwill when I was about 500-1000 over.
 
After 2 weeks with no car- not even a rental- I had to call Infiniti Canada to find out what was going on with my vehicle. Stefanie at Infiniti told me that the dealership should have called on on Tuesday to give me the final notes on the decision. No one from Alta Infiniti called me and here I am 2 days later calling them. She told me that the final decision from Infiniti Canada was that they would not be helping me with the vehicle because I am out of warranty. I told her that I had all my service records and would be willing to share them with Infiniti to prove that I had been servicing the vehicle. She said that she appreciated that I was willing to share them but the decision was already made. We discussed further and she said that she was sorry that they could not do anything else for me.

Unbelievable! After only owning this luxury car for 2 years this is the type of service, type of quality product that I get? Infiniti should be embarrassed to have an engine like this on the road. Its unsafe and will end up costing you thousands. Im going to keep fighting this as best I can through arbitration.

Yes - I have a contact a major newspaper in Toronto. I've already talked to him and he's willing to include me in a write hes doing on the industry - specially related to warranty issues. I also am in the print and advertising industry so I will absolutely be spreading the word as far as I can with my resources.
 
I think this is really somehow related to your dealership, and not Infiniti as a whole. As I mentioned before, both my engine and my dash board were out of warranty, and I got them both replaced at a local dealership (Ellis Infiniti) with no questions asked and free of charge...

I decided to go ahead with arbitration through CAMVAP for my issue with the engine. I went to a meeting where I met a lawyer from Infiniti and the arbitrator from CAMVAP to review my case. We both had opportunities to present our arguments. I presented my bill of sale for the vehicle that stated that the car was a CPO, all of my oil change invoices including the most recent at 110,000km and a few other documents to prove I had a case. After a few questions from the arbitrator and Infiniti's lawyer, Infiniti's lawyer presented notes from the dealership that suggested that the car was not maintained properly and there was sludge. They even said that they took off the oil pan to see if there was any signs of damage - the best part of this is that they said they replaced the oil with the same oil that was in the engine! The arbitrator said that he would review both arguments and get back to us with the next course of action. After the meeting ended I felt really good because I had presented a great argument with the help of my friend who owns a dealership.

A few days passed and I received an email from CAMVAP stating that they were going to move forward with a third party inspection. A week later I met with the dealership, the Infiniti Tech Service Manager and the inspector to look at the vehicle closer. The inspector checked the oil from the dip stick, fired the engine up and took a bunch of pictures. He said the arbitrator would contact me once he reviewed the inspectors report.

A week passes by and I receive another email from CAMVAP stating they will be doing a second inspection. We met at the dealership where my truck was up on the hoist. They drained the oil and pulled the oil pan off. You could see there was metal shavings in the oil as it was pouring out and also when the inspector was looking at the inside of the oil pan. He ran his fingers through the oil pan and snapped a bunch of pictures of the oil running back into the pan. He also inspected the oil gallery to see if there was any damage. We could all see that the oil was smooth except for the metal debris and there was no sludge. The inspector had authorization from CAMVAP to move forward with a complete tear down of the engine to determine where it failed. This would have been scheduled with the dealership 2 weeks from that day.

At this point I was very happy that they were going to move ahead with the teardown to see where it failed. Only 4 days after our meeting at the dealership, out of no where, I received a call from Infiniti's lawyer - the lawyer from the first meeting. I almost missed the call but answered in time. The lawyer told me that after further review, they have determined that even though the engine is outside of warranty on km's they will replace the engine at no charge. They would be ordering the engine and it would arrive at the dealership for replacement. Wait a sec... WHAT??? After 5 months now you realized this? The lawyer told me that they would send a consent award to CAMVAP and I would need to respond. I verified that the engine was a brand new factory long block (not reconditioned). I also asked for a rental while the repairs were being done and 1 year warranty on parts and labour. I signed the consent and sent it back. The new engine was installed in 3 weeks - yes 3 weeks to install an engine! haha.

After 5 months, I finally picked up my FX50 yesterday. N/C on all items.

So what was the issue after tear down inspection?

They called me before the scheduled teardown and offered me the replacement. So the teardown never happened. Im curious to know why. I asked the manager at the dealer and he said they just told him to replace it.
 
Way to go dude, they were taking you for a ride and you showed them they can't fuck with you.

I bet you are on the highest high right now... Brand new engine...

I wish I could get a new engine (and not a VQ but a VK...) :disapointed:
 
Great news, I know you are ecstatic that it worked out in your favor. Who wouldn't want a new engine? Lol I'm just sorry to bear you had to go to such lengths to get progress. Bright side is, it worked out for you in the end and anyone in the future who has this type of issue knows how to handle this it if they get the run around.
 
So glad to hear that you finally got this straightened out.
Curious as to what brand oil you used, and it's too bad they couldn't do the tear down to find a cause of the failure.
