Got Pulled Over

yea yea, I know, I am an idiot. No doubt about it.. Got pulled over for 'racing' while i was just, uhm ,trailing an is350 at just a lil over the speed limit speeds. Story short, the cop accused me of going 110 in a 55. Funny thing is, he wrote up the ticket ($1150) for VBR. I think what saved me from being arrested and getting charged with reckless driving and getting a ticket for racing was the fact that I denied everything. Told him he got the wrong guy. I am pretty sure if I admitted to something, he would have written everything up.

Question is: Since he caught me by 'pace', are these easier to fight and prove non-guilty, than those with laser or radar? ...and what is a VBR? Usually tickets say 'speeding'. I am more than likely to hire and attorney. I am just curious if any of you had any luck with 'pace' tickets for higher speeds..

attorney is the way to go, even if you do lose the attorney will get traffic school. Which is impossible in your case

YES! Get an attorney. I got popped at 110 in a 65 eight years ago. Ended up going to jail for a month instead of six.

You can't fight alone. Find someone who has had prior experience with the judge or a former-state-defense-attorney-turned-private-practitioner who has ties to court you show up in.

I was also paced at speeds over 140 in an IS300. So, my officer brought out the gun and clocked me at 110 even. Maybe yours could have done the same. It's also his word over yours no matter what.

yup plus you wont get points in your driving record and your insurance rates wont hike up. 99.9% of the time good ticket lawyers will get you traffic school, or just try to dismiss it. It has worked for me in the past, better to pay 500 for the attorney then 1500 for the ticket plus the insurance fees and etc

Also lets not forget losing your license, some judges will suspend it for months.

You went to jail for a month for doing 110 on the freeway?

you Americans have to go to traffic school if you get caught speeding? If we get caught doing 50 over they impound your vehicle

I'm pretty sure in California, if the cop writes you up 25mph over the speed limit, you will NOT allowed to attend traffic school... I'm sure if you are caught going super fast, they'll impound the car and/or arrest

Man that's crazy. Hope you get a reasonable resolution. Please keep us posted.

...and what is a VBR?

It says Violation of Basic Rule

Violation of the Basic Rule (VBR) ORS 811.100
A person drives a vehicle upon a highway at a speed greater than is reasonable and prudent, having due regard to all of the following:
a) the traffic
b) the surface and width of the highway
c) the hazard at intersections
d) weather
e) visibility
f) any other conditions then existing

Man, thanks for the replies.. Surprised that some areas have significant jail time for such offenses. Honestly, that's what was worrying me a bit. Now, waiting for Monday to do some lawyer shopping.

40km/h over the legal speed limit in BC and your car is automatically impounded for 7 days. Had this happen to my FX not long after I got it. I got clocked at 150 in 100 zone.

Really? Maybe that's why I see so many BC cars speeding here in WA. They just want to go a bit faster without getting into much trouble perhaps ;)

I just got a ticket for going 84 in a 65 (radar, but i was actually doing closer to 90) in eastern Oregon a couple weeks ago and only got a $276 fine. I don't even have to go to court. I'll probably write a very verbose and apologetic letter to the judge requesting traffic school and send it in with a check. Maybe have my speedometer calibrated again and include the receipt. I had a speeding ticket treated like a "fix it" ticket once for doing that. It cost me like $50 at a local shop.

Fwiw, I never deny or admit to anything with police anymore and speak as little as possible. I've had more than my share of moving violations and found that 90%of the time it's better to save the explanations for the judge.

I'd have to be facing some hefty fines to hire a lawyer for a traffic ticket...

I agree, talk as little as possible and don't admit to anything. They try and get you to admit or acknowledge guilt.

^^^ Good info. Illinois just changed their law about speeding about 2 years ago, anything 30 over the posted speed is suppose to result in automatic 1 year jail+fines and impounding of your vehichle. Right before this change happened I was pulled over in my SLP SS for 112 in a 55 on the tollway. A State Police patrolwomen really wanted to throw the book at me with Reckless, illegal lane change, following too closely and speeding. Somehow I gave her reasonable doubt by saying I was trying to make an exit ramp and someone would not let me in so I dropped the hammer to get in front of them. It's only half true but my playing the stupid appologetic man got me only 2 tickets and I was sent on my way. Got a good lawyer and on my court day, was one of the last people before the new law passed to recieve court suppervision. My lawyer said they are really trying to make examples of speeders and in the future it would be easier to get me off on a DUI under the posted speed limit rather than excessive speeding sober. Crazy right? Anyhow I have heard though from within the red and blue some officers now will not go the extra mile and tow/arrest you on spot unless you are being extremely reckless or a complete arss. Regardless I am no saint but as I grow older I push my luck less and stay aware of my surroundings more.

So called a few lawyers today. Kept getting referred to the same one. Finally called him. I guess this type of ticket is literally impossible to fight in that specific court with that specific officer. He basically said the fact that I didn't get arrested and got charged with reckless driving is already a miracle. He also said that even thought 'pace' does not seem as accurate as 'radar', it is not treated as something that is less-accurate. Basically, if an officer has proof that his speedo is calibrated, it is sufficient. Best thing that apparently can be done is an attempt to waive the suspended license for traffic school + fine. Probably what I will go for. You live and you learn.
