"VDC OFF" sign and traction control light stays "ON"

My 2010 FX35 AWD recently having problems with VDC OFF sign and traction control light lights up and stays on whenever when I floor the accerelator.
It does not happen every time and it is not on the curves. I happens on the straightaways when i.e. I get in to the highway from an exit.

As I lights up it stays lit and I try turning it on with the VDC button, it does not turn back on.
In order to make it go away, I have to stop the car and turn it off.

I read on the manual that this may happen when you do not have Infiniti recommended part and wheels.
I have an aftermarket rim and tire. 20"x10" 260/50/R20.
The only thing that it is weird about the statement on the manual is the fact that I have this rims on the car for a year and half already with aprrox. 25000~30000 miles on it and this is the first time it is showing this problem.

Monday, I will be dropping off at the dealership to be taken cared but just wondered if any of you experienced this.

^ +1 brake fluid could be low, our rides are very sensitive to this, the fluid does not need to be down much..
 
REALLY? hmmm I would never thought that brake fluids would have anything to do with VDC on straght accerelation but I will check on my lunch break.
 
I had this problem before. It does it on straight hard acceleration because the fluid moves around when accelerating when its low in the reservoir and triggers the sensor that the fluid is low.
 
I went to dealership and they have top it off. So far (it's only the second day though) the lights have not come back on. Thank you so much for all your comments!!!! Glad that I relied on you all!!!
 
If your fluid goes down too much though, make sure to check for worn brake pads.
 
Its not always the brake fluid. This happened to me and did the brake fluid with no change. I had to buy a scanner for the VDC and traction and ABS lights and it turned out that I had to replace my hub bearings and my 2 front ABS speed sensors. Then the problem and lights were gone.
