2010 FX35 transmission issue

Hi everyone, I just bought a 2010 Fx35 a few months ago and experienced the hesitation in acceleration (always ) and harsh downshift (sometimes). I took it to the dealer to get ecm and tcm reprogrammed. However, the problem still existed and the dealer won't do anything about it. They keep saying my car has already has the latest software and they can't do anything about it. It seems that the latest tsb fixed most of the cars and I wondered if anyone had the same problem even if after the reflash.

Hi Fire0nic3FX, thanks for the reply. I had the reprogram done with the latest TSB (the 3rd one). According to the dealer, I am having the latest software but the problem still existed. I don't know what I should do, I hate to bring the car to the dealer back and forth, and they keep saying the lag is normal and I should wait to see if there is another TSB about this.
